Nicole Parra has withdrawn AB 1604 from the legislative process after receiving heat from many different sources and losing some support from her own Ag Committee. Most of the opposition came from Big Dairy and Food Safety Interests. Because AB 1735, with its baseless coliform standard, is now the law of the land, it was impossible for many to view AB 1604 in a positive light, as it seemed to reverse food safety standards.

Unprecendented Support Caught Sacto by Surprise
The AB 1604 process was so fast and support from CA raw milk consumers so strong that AB 1604 became a public scramble to repair an injustice. (Seldom do 700 supporters show up with just three days' notice. Never have healthy kids, moms, and doctors lined up at a hearing microphone to tearfully beg for a food product.) In the interest of building understanding about raw milk, Ms. Parra has created a special Raw Milk Study Committee to research raw milk and give concrete recommendations on appropriate bacterial standards.

Clearing the Air about Coliforms
Before AB 1604, little attention was paid to raw milk, and coliforms were a mystery to California regulators and lawmakers. Even though AB 1604's "less than 50" coliform rule has been used effectively in Connecticut for many years, it is seen as an arbitrary limit by many in California. This new committee will include pro-raw milk scientists and Medical Doctors, PhD researchers, veterinarians, raw milk retailers, consumers and producers. Representatives from CDFA will also be included.

All stake holders will be represented and the coliform recommendations will be fully defendable.

Claravale and OPDC support this research and study process
This study group will allow raw milk to be brought forward into the normal channels of discussion; finally the facts will be known. It could very well bring forth additional recommendations and protections for raw milk that current law does not provide.

Count your blessings for our raw milk champion, Nicole Parra
This Wednesday, Assemblywoman Nicole Parra chaired an important conference call on this matter. Her opening comment to more than 10 people was that she loved the raw milk OPDC had given her last week. She has severe lactose intolerance, yet found this milk tasted wonderful and caused no problems! She wanted everyone to know that she supports consumer choice and has dedicated herself to making sure that raw milk standards are right and consumers choices are protected.

She will introduce a new raw milk bill when the committee has made its recommendations. Hearings will then be held, and we will show like never before!

In the mean time, raw milk will continue to flow without interruption. Stay tuned for more as the committee is selected and the recommendations are studied.
Thank you all for the incredible passionate support given by raw milk consumers. After January 16, 2008 Sacramento's view of raw milk, its consumers, and the political process will never be the same. You have changed things for the better.

Thanks to last minute "hallway negotiations," Assembly Bill AB 1604 passed with unanimous consent during Ag Assembly hearings held on Wednesday. This will ensure, for now, the continued flow of raw milk in California.

It was standing room only at the State Capitol on Wednesday January 16, 2008. Room 4202 was packed to its capacity with over 400 people, including scores of children on parents' laps. The hallway was filled with overflow crowds. Judging by the number of “I love Raw Milk” pins handed out, the total crowd was estimated at 700.

Assembly members Nicole Parra, Tom Berryhill and Mike Villines sealed the fate of AB 1604 with impassioned speeches berating the sloppy governmental process around AB 1735. Testimony was heard from Collette Cassidy and Dr. Ron Garthwaite of Claravale Dairy, Wholefoods Co-president Walter Robb, and Organic Pastures Founder Mark McAfee. More than 75 people spoke at the microphone supporting their choice in raw milk – among them doctors, nurses, pharmacists, PhDs and, most importantly, children, mothers and fathers. 

AB 1604 is a deal we can all live with

Ideally, AB 1735 should have been reversed so as to eliminate the baseless raw milk coliform standard it included. However, the political reality of the moment said otherwise. Allies to the anti- raw milk forces were deeply imbedded in the hearing committee. The mainstream dairy industry and the California Medical Association also stood against AB 1604. Without last minute negotiations to modify AB 1604, it would have “died in committee” and AB 1735 would be the law of the land. Raw milk availability would have become subject to the uncertainties of litigation, and this was a risk for raw milk consumers that we were unwilling to take.

The results of the vote are as follows:

AB 1604 passed as a committee bill and will go forward as a “consent item.”
AB 1604 stops all coliform testing for six months.
AB 1604 allows for additional hearings to be held about coliforms and to review the science, including a six inch thick package of research and support documents submitted at the hearing.
AB 1604 allows for a less-than-50 coliform per ml “in the first bulk tank” starting July 2008. This is achievable and fair, and most importantly satisfied the parties in opposition.
Nicole Parra reads CDFA the riot act

In a rare scene seldom witnessed at the Capitol, Assemblywoman Nicole Parra admonished the CDFA for its deceitful attack on the democratic process, and for misleading the legislature, saying such a process "will not stand." She insisted AB 1604 pass out of the committee, and said it would fail “over [her] dead body.” She was particularly passionate about the fact CDFA had cheated the people out of the democratic process. Republican assembly whip Mike Villines strongly supported Nicole, saying a mistake had been made which will now take courage to correct. Assemblyman and Ag Committee member Tom Berryhill wanted a search for who in the CDFA did this, stating that “heads should roll.”

Gifts of raw milk and a march to the governor's office

After the hearings OPDC quarts of Raw milk were given away to all who attended. Then hundreds of supporters marched to the governor's office with a gift of raw milk, to ask for his support. A smaller group also sought support from the speaker of the senate. OPDC marketing director, Kaleigh McAfee, gave raw milk to Nicole Parra, who is lactose intolerant. The word is that she enjoyed it and had no problems at all!

Next Steps

January 16th was a  great day for raw milk but the work is not completed. The next step is to contact your state assemblyman and ask for support of AB 1604 at next vote. Tell them it is a “consent” bill that includes a compromise and has everyone’s support. When the vote is closer, we will be asking you to contact Senator Dean Flores as well.

Misleading email leaves consumers wondering

A very misleading email was sent out recently by a raw milk consumer advocate implying that raw milk is now illegal in California. This is not true!

Raw milk is legally available in California, and has not been banned!

Please see Organic Pastures' News Archives for the latest in accurate information.

A new testing standard is being implemented over the next several weeks and months. Organic Pastures and Claravale, California's two commercial raw milk dairies, are engaged in that process and have meanwhile established three layers of protection to secure your continued access to their fresh and delicious raw milk.

These protections include:

A lawsuit filed on 12/27/07 to stop the enforcement of AB 1735.

Strong support and a clear political process to reverse AB 1735 starting in January.

Dialogue with CDFA and the Secretary of Agriculture with a promise that raw milk will not be banned by AB 1735 or any other means.

Dr. Price in his book (Nutrition and Physical Degeneration) wrote:

I was inspired to find this quote by reading a reference to it in: "Cure Tooth Decay" by Rami Nagel: http://www.curetoothdecay.com/
in his free preview download that is well worth getting!.  (This might be the best Price-based book on how to cure cavities).  Rami says that the evidence "of his Being in the life-giving qualities of butter ..." is "Activator X" which Rami says is also known as Vitamin K-2.  I believe the credit for identifying Activator X as Vitamin K-2 needs to go to Chris Masterjohn  ( as reported in his article published in the Spring '07 issue of the Wise Traditions journal).

I want to celebrate this image of "... the lighting of a wick in a bowl of the first butter ... permitted to burn in a special sanctuary built for the purpose" where "the natives of the valley ... pay it due homage".
I also want to contrast this radiant living image with all the images of industrialized dairy commerce.  The former image carries a tradition of the highest regard for the cow and it's amazing products that have  supported  entire communities.   In contrast we see that the industrialization and transformation of real milk  ( away from the quality that was once worthy of being paid homage to)  is so far removed from biological environments  and practices like those mentioned above,  that all the  commercial images of "contented cows" and the like are possibly criminal if held to the highest possible  standards of "truth in advertising"!  I ask the industrialized dairies: Where are these missing "life-giving qualities".  Where is the life-giving milk and butter that is worthy of our homage? Where is "the grass", man?

CALIFORNIA GOVERNMENT OFFICIAL LIES ABOUT RAW MILK
For immediate release. January 4, 2008

Raw milk proponents who have claimed that government officials often deceive the public about the safety of raw milk found clear evidence of this practice in a recent statement from the California Office of Constituent Affairs.

A letter signed by David Richey, Office of Constituent Affairs, sent to California consumers of raw milk, states that in September 2006, 'the California Department of Public Health linked six cases of infection with the deadly E. coli O157:H7 to the consumption of raw milk.'  The letter refers to the September 2006 outbreak of virulent E. coli now definitively tied to spinach grown in California.

Although officials of the California Department of Food and Agriculture (CDFA) accused Organic Pastures Dairy, California's main producer of raw milk, of selling tainted milk, thorough investigation of the milk, the cows and even the manure at Organic Pastures Dairy failed to find virulent E. coli or any other pathogen.

The state was forced to make a monetary settlement to compensate Organic Pastures Dairy for loss of business during the unnecessary two-week recall.

'The actions of California officials typify what we are seeing in many parts of the United States,' says Sally Fallon, president of The Weston A. Price Foundation, a nutrition education foundation that promotes the consumption of raw milk. 'Raw milk is often the whipping boy for illness caused by other foods. Health officials publicize a "link" between raw milk and illness on little or no proof and ignore much more likely vectors of illness, such as salads or deli meats. They can find a "link" between raw milk and illness by asking victims about raw milk consumption and not about other foods they have consumed.'

Fallon notes that In September, 2003, the FDA, USDA and CDC jointly released a report comparing the risk of listeriosis carried by various foods.  On a per-serving basis, this report estimated that deli meats are 10.8 times more dangerous than raw milk and that non-reheated hot dogs are 9.2 times more dangerous than raw milk.  Since deli meats are so commonly consumed, on an absolute basis they carry 515 times as great a risk as raw milk.

Furthermore, two people recently died in Massachusetts from listeria in pasteurized milk. 'Where are the government warnings to avoid deli meats, hot dogs and pasteurized milk?' asks Fallon. 'Only raw milk is singled out as a menace.'

The letter from the Governor's office also states that 'raw milk sold for direct human consumption is illegal in all or part of 42 states.'

'Once again, the state of California is lying to the public,' say Fallon. 'Raw milk may legally be sold in over 30 states and may be sold in stores in eight states. California citizens whose health depends on access to raw milk deserve fair and accurate statements from public servants, not lies and misinformation.'

The new standard passed by the Legislature in AB 1735, without hearings or debate, sets a maximum amount of beneficial probiotic coliform bacteria at no more than 10 bacteria per mL in milk sold raw to the consumer.  If enforced, AB 1735 could make raw milk unavailable because coliform bacteria-which are harmless-multiply rapidly when milk is machine bottled.

Just before AB 1735 took effect, January 1, 2007, the Farm-to-Consumer Legal Defense Fund filed a lawsuit in San Benito County. Part of that lawsuit requests an injunction which would legally protect raw milk producers against enforcement of AB 1735 standards.  In addition, a new law will be introduced in January reversing AB 1735.

'AB 1735 unfairly targets raw milk and is not necessary for public safety,' says Taaron Meikle, president of the Farm-to-Consumer Legal Defense Fund. 'The two raw milk dairies in California have a superlative safety record.'

The Farm-to-Consumer Legal Defense Fund (FTCLDF) defends the sale of raw milk and other farm products directly to the public. In states where raw milk sales are illegal, FTCLDF helps farmers provide raw milk to consumers through cow-boarding and herd-sharing contractual agreements. "

Raw milk lovers will be better informed and therefore more empowered by being aware of all the perspectives relating to the raw milk controversy.  There is one essential perspective that  needs to be  presented now and that is for us to look at this issue from the Rights sphere.

Article I, Section 10 say that "No state shall ... pass any ...  law impairing the obligation of contracts ..."

This is a crystal clear limitation on every California State legislator!
Any legislator who has enacted the recent "law" on raw milk can be held liable for the financial losses of the dairies when the dairy's  milk is  prohibited from being delivered to  retailers. That prohibition would be  " impairing the obligation of contracts"! (Keep in mind we are looking at this from the Rights perspective and not "health & safety" or any other perspective.)

 The legitimate function of government is primarily to protect the Rights of the people. California is obligated by the "supreme law of the land" and by it's own constitution to protect the rights of the people and in this instance the Right of contract!  I wonder if the legislators were thinking about what impact their legislative act might have on the raw milk dairies and their business contracts will retailers. If each and every legislator were to get a bill for all the financial losses from the dairies I imagine they would quickly begin thinking about their act and it's impact! Providing there is evidence of a pre-existing contract between dairy and retailer the dairies have the right to bill the legislators for each day that they sustain losses on account of government blocked milk delivery.  Let's see now, I roughly  estimate there are about 30,000 customers at $10/week = $300,000 divided by 7 = over $42,000 per day! I don't know how many legislators were involved in this act but when it's all figured out I know the bill will be nothing for the legislators  to sneeze at!
